Using Contracts to Manage E-Discovery Risks

eDiscovery Risk Contract

Karl Schieneman, Founder and President of Review Less, moderates a special ESIBytes show with guests Jonathan Redgrave from Redgrave LLP and Jay Brudz from Drinker Biddle.  In this podcast, the guests talk about their article from last year entitled Using Contract Terms To Get Ahead of Prospective E-Discovery Costs and Burdens in Commercial Litigation, published in the Richmond Law Journal. It’s an excellent idea which hasn’t received enough publicity and the group will try to remedy this with a podcast.

The authors are excellent guests and it makes for an entertaining and useful show as they walk through the article and the arguments for using contracts to limit risks. The real challenge is getting more corporate lawyers aware of how to manage e-discovery risks.  In addition, the guests also talk about why it takes so long for e-discovery as an industry to pick up on good ideas.
