Listen to Karl Schieneman, Adjunct Analyst with the E-Discovery Journal and Founder/President of Review Less, a predictive coding consultancy, as he moderates an interesting podcast. Joining Karl are Bruce Fein, Legal Director at Backstop LLC, a predictive coding software vendor, Graham Rollins an associate and member of Morgan Lewis’ eData Practice, and Tom Gricks a partner at Schnader Harrison and the head of their predictive coding department.
The group will talk about the decision in the In Re: Biomet M2a Magnum Hip Implant Products Liability Litigation (MDL 2391) which recently issued a predictive coding order in the Northern District of Indiana supporting the pre-cull of ESI using keywords before predictive coding is used. This should be a very interesting podcast as we dive into the math behind the decision and explore if the case maybe should have focused more on the recall results shown by sampling of the date being reviewed than precision results and proportionality arguments which the court found persuasive.
